Saskatchewan is a “no-fault” jurisdiction, meaning that there is no right to sue negligent drivers for injuries sustained in automobile accidents. Depending on the type and extent of the injury, those injured are compensated directly by SGI for their loss. Their decision on the type and amount of compensation may be appealed. We have extensive experience in this area and have appeared many times before the Automobile Injury Appeal Commission in pursuit of obtaining the best results for our clients.

The Automobile Accident Insurance Act allows individuals who have been injured by drunk drivers to recover general damages for their pain and suffering. The Act also provides that those who elect “tort” coverage rather than “no-fault” coverage may bring claims for injuries directly against the negligent driver. Our lawyers have experience representing injured motorists in court where they have elected tort coverage or where they have been injured by a drunk driver.

In addition, Mr. Zakreski has considerable trade-mark and patent infringement court experience. In the landmark patent case, Monsanto v. Schmeiser, Mr. Zakreski represented Percy Schmeiser at his Federal Court trial, his appeal before the Federal Court of Appeal and finally the Supreme Court of Canada.
