Since 1994, Saskatchewan has been a “no-fault” jurisdiction, meaning that there is no right to sue negligent drivers for injuries sustained in automobile accidents. Recent amendments to The Automobile Accident Insurance Act, however, have enabled Saskatchewan residents to elect “tort” coverage, allowing such individuals to bring legal claims for injuries sustained in motor vehicle accidents. Furthermore, the Act allows individuals who have been injured by drunk drivers to recover general damages for their pain and suffering.
We have extensive experience in bringing claims by injured motorists where they have elected tort coverage or where they have been injured by a drunk driver. Further, we have appeared many times at appeals before the Automobile Injury Appeal Commission.
